"Thank you for your email received on the 28th of August 2013 regarding your child support payments.

We have not recovered any further information in which to enforce collection of child support from Mr XXXX.

We will now see if the case meets the criteria to be referred on to the legal team.
This can be a lengthy and involved process so we are not able to provide you with a timeframe.

If you have any new queries in the future, please do not hesitate to contact us."

So, um.. "We'll see, but we won't tell you when you'll know."


I guess that's something? I'm just not sure what. Oh yeah, and their site is back up and I did the maths. The current debt is $10,086. Less about $200 if he suddenly starts paying the $30 a month he's supposed to pay for this year. That's more than I thought. It'd pay for a fair bit of tuition now, wouldn't it?

yup that would pay for a nice chunk of tution, or travel or a preverbal nest egg..

also $30 a month,, gosh child support sure has not risen in its payment much, my father used to pay $14 a fortnight way back in the 70's, which because he was in the navy they took from his wages... mind you he also promised that he had put aside money for my education or whatever.. but like your x that was all just blowing in the wind really..

err yeah.. *thoughts*

Heh, that story sounds familiar.

Child Support is calculated on a percentage of the paying parent's income after a living allowance is taken off. When he had a regular job for 6 months, it was taken from his employer, and that year he was assessed to pay just under $8,000, or $654 a month (which is, incidentally, a little less than what I was paying when the YoT lived in Dargavilee). I got just over half of it before he got sacked and disappeared.

This year, he was assessed to pay $436.20. That is half of the minimum that a paying parent is required to pay. It's half because he split with his wife and is now liable for their daughter as well. He hasn't paid any of it, and I'm a monkey's uncle if he's actually got that low an income.

What, they are "checking if this warrants being transferred to legal"!?!?! WTF?

a) Who else but Legal would be qualified to check?

b) That guy didn't pay up for ages - even an illiterate who never heard of child support laws would guess it's time to get an attorney.

These people seem not very competent to me... let alone helpful.

And you haven't been reading my blog long enough to see the full comedy of errors, either.

At one point they thought I was on a benefit (which I haven't been for over 12 years) and started giving my money to WINZ (the govt dept that deals with benefits) to 'offset' my supposed benefit.

Then another department overpaid me by $900 and forced me to pay it back 18 months later even though they know I'm owed all this money - they wouldn't let me offset the debt against Child Support they were (trying to) collect for me.

And one of the funniest ones was back in the early days when he was paying about every second or third month, they thought they'd overassessed him for one month and tried to make me give them $300 to give back to him, even though at that time he owed me about $1500.

This is normal here. There are folks who are owed way more than me and have been for way longer. And we all just accept it because dealing with this giant bureaucracy that says 'yes yes' but achieves zero outcomes is more stressful than it's worth for what you get out of it.

So I have resorted to twice-yearly somewhat facetious emails and the occasional phone call to remind them that a) I exist and b) I'm aware of their lack of outcome on my behalf and still care about it, and there's a small flurry of activity that occasionally results in a payment.

The problem with lawyers is they cost, and also, there's an emotional cost to making that effort in that I would have to have contact with the YoT's father again, a thought that leaves me going OH HELL NO. In many ways, leaving it to the IRD is slow and disappointing, but they do chase people till they're dead and then take money from their estate, so I will eventually get it.

It's enough that I'd possibly have a chat to a lawyer personally to see what options you have available to you, if you haven't already. I can't help but think that even if you haven't got much chance of getting money out of your ex, you might well have a case against IRD itself.

Of course, that is the equivalent of standing on top of Mt Cook in the middle of a thunderstorm wearing a copper nose-ring and shouting 'All gods are bastards!' at the top of your lungs. And it could well leave you worse off than when you started. But...

I am operating under the assumption that a private lawyer would have no more legal rights to extract assets from the man to cover his debt than the IRD would. They would likely be faster, but would cost more, both in money and in emotional upheaval. I want nothing to do with this man, ever. Going through lawyers is a last last LAST resort.

As for taking on the IRD, I suspect that trying to get some traction for my story in the media would be more likely to yield a result. I did try once before, but that was a few years ago and the debt was smaller then. However, there are people who are owed a lot more than me and have been for way longer, and even their stories aren't being told - so *shrug* who knows?
